This document contains two separate notices: Part I addresses the website and general online information, and Part II addresses protected health information (PHI) relating to health care. When information is PHI, applicable privacy law and Part II control. The practice should verify the operational details identified in the accompanying publication checklist before posting.

PART I — WEBSITE PRIVACY POLICY

1. Who we are

New Day Behavioral Health (“New Day,” “we,” “our,” or “us”) provides psychiatric evaluations and medication management, including in-person and telehealth services. This Website Privacy Policy describes information collected through www.newdaybehavioralhealth.com and related online communications. It does not replace our HIPAA Notice of Privacy Practices, which describes our handling of PHI.

2. Information we may collect

Information you voluntarily provide, such as your name, telephone number, email address, preferred location, and the content of a request for an appointment or other inquiry.

Technical and usage information that may be provided automatically by your device or browser, such as IP address, device and browser characteristics, pages visited, referral information, and dates or times of visits.

Communications information, such as records of correspondence and interactions with our office, as permitted by applicable law.

Information processed through third-party links or services, such as a patient portal, scheduling platform, or telehealth provider, subject to their applicable notices and our responsibilities under HIPAA.

A communication to us about symptoms, treatment, appointments, or other care may contain PHI and will be handled as required by applicable law. Do not send urgent concerns or unnecessary sensitive medical details through a general website contact form. Call our office for guidance on appropriate communication methods. For emergencies, call 911 or go to the nearest emergency department.

3. How we use information

Respond to inquiries, communicate about requested services, and coordinate appointments.

Operate, protect, troubleshoot, and improve our website and administrative processes.

Measure general website performance and understand how visitors find our website, where permitted by law.

Prevent abuse or fraud, support security, and comply with legal obligations.

Provide information about our services when permitted by applicable law and applicable patient preferences.

We do not sell PHI. We do not use or disclose PHI for targeted advertising without a lawful basis and any authorization required by HIPAA or other applicable law.

4. Cookies, analytics, advertising, and similar technologies

Our website or the vendors that help operate it may use cookies or similar technologies for website functionality, security, measurement, or marketing. Certain technologies can collect browser identifiers, page interactions, referral sources, and other usage information. Available choices may include browser cookie controls and, if offered on the website, a cookie preference mechanism. Browser controls may affect website features.

We evaluate the information collected and transmitted by any analytics, advertising pixels, or tracking tools to determine whether it is subject to health privacy protections. We do not authorize third-party advertising tools to receive PHI except as permitted by law and with any required safeguards and authorizations. Technologies actually deployed on our site, including any Google or Meta tools, must be confirmed against this statement before publication.

5. When we disclose information

We may share information with website hosting, communications, scheduling, technical support, payment, or other service providers that help us operate the website and practice; with your direction or consent; and when needed to meet legal requirements or protect rights and safety. Where a vendor handles PHI for us as a HIPAA business associate, we use required business associate arrangements and other safeguards. We do not give third-party advertisers access to PHI merely because they provide advertising or analytics services.

6. Website forms, patient portal, and external links

General website forms and ordinary email may not be appropriate for transmitting detailed medical information. We may direct patients to approved clinical communication channels for medical questions, records, prescription requests, or treatment concerns. If we offer access to an external patient portal or telehealth service, the linked service may have separate technology features and privacy documentation; PHI remains subject to applicable legal protections. External websites are responsible for their own content and privacy practices.

7. Security

We use administrative, technical, and physical safeguards appropriate to the information we handle and legal requirements. When transmitting sensitive information online, we seek to use appropriate encrypted connections and secure systems. No internet transmission or storage method is guaranteed to be completely secure. Please contact our office if you believe information has been sent to us insecurely.

8. Retention

We retain website and administrative information only as long as reasonably necessary for the purposes described in this Policy, or as needed to comply with legal, regulatory, security, or recordkeeping requirements. Retention periods vary by the type of information and the systems involved. PHI and clinical records are retained according to applicable medical record requirements and our record-retention policies.

9. Your choices and rights

You may choose not to provide optional information through our website and may adjust browser cookie settings. To ask about information provided through this website or exercise applicable privacy rights, contact our office using the information below. Rights concerning PHI are described in Part II. We will honor requests to the extent required by applicable law.

10. Children and geographic scope

Our website is intended to provide information about our healthcare services in the United States. Services for minors are provided through appropriate clinical and consent processes; our public website is not intended for children to submit personal information independently without appropriate parental or guardian involvement where required by law.

11. Updates and contact

We may revise this Website Privacy Policy to reflect changes in law, practice operations, or website technology. An updated version will be posted with a new effective date. PART II — HIPAA NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our responsibilities

New Day Behavioral Health (“New Day”) is required by applicable law to maintain the privacy and security of protected health information (PHI), provide you with notice of our legal duties and privacy practices, follow the terms of the notice currently in effect, and notify affected individuals following a breach of unsecured PHI as required by law. We will not use or share PHI other than as described here unless you authorize us in writing or the law permits or requires it. You may revoke an authorization in writing except to the extent we have already relied upon it.

How we may use or share your PHI without your written authorization

Treatment: We use and disclose PHI to provide, coordinate, and manage your care, including communication with treating healthcare professionals and pharmacies, when permitted by law.

Payment: We may use and disclose PHI to bill and receive payment for services, verify coverage, and process claims.

Healthcare operations: We may use and disclose PHI for quality improvement, staff training, compliance, credentialing, auditing, administration, and other lawful healthcare operations.

Other permitted or required purposes: Depending on the circumstances and applicable restrictions, we may disclose PHI to business associates bound by appropriate protections; to people involved in your care consistent with your preferences and the law; for public health and health oversight; for reporting abuse or neglect; to comply with applicable law and qualifying legal process; for certain law enforcement or government functions; for workers’ compensation; to coroners or medical examiners; for approved research; and to avert a serious threat to health or safety. Some categories of sensitive information are subject to more stringent federal or Tennessee protections. Not every disclosure listed here is automatically permitted in every circumstance.

Uses and disclosures needing authorization

Except as permitted by law, we generally obtain your written authorization before using or disclosing PHI for marketing, selling PHI, or using or disclosing psychotherapy notes where a separate authorization is required. Most other uses and disclosures not described by this Notice also require authorization. You may revoke authorization in writing as provided by law.

Extra confidentiality for substance use disorder records

Certain substance use disorder (SUD) records protected by 42 CFR Part 2 have special confidentiality requirements. When New Day receives or maintains records subject to Part 2, we use and disclose them only as allowed by Part 2 and other applicable law. For example, a patient may provide a single consent for certain future uses and disclosures for treatment, payment, and healthcare operations, subject to applicable restrictions and rights. Part 2 records generally cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient without the required patient consent or a qualifying court order and other applicable requirements. A consent for use or disclosure of Part 2 records for fundraising purposes may be subject to a right to opt out. The restrictions and exceptions are determined by the law and the circumstances, not simply by whether care relates to substance use.

Your rights regarding health information

Access and copies: You may ask to inspect or receive copies of records in a designated record set, including an electronic copy where available, subject to legal limits and permissible fees. We ordinarily respond within the time required by HIPAA.

Corrections: You may ask us to amend information that you believe is incorrect or incomplete. We may deny certain requests with an explanation.

Confidential communications: You may ask us to contact you in a particular way or at a particular location. We will honor reasonable requests as required by law.

Restrictions: You may ask us to limit certain uses or disclosures. We generally need not agree, except that we must honor a qualifying request not to disclose information about a service to a health plan for payment or operations when you paid for the service in full out of pocket and other conditions are met.

Accounting: You may request an accounting of certain disclosures made during the period specified by law, subject to exceptions.

Notice: You may request a paper copy of this Notice at any time, even if you have agreed to receive it electronically.

Representative: If someone has legal authority to act for you regarding health information, we will generally recognize that authority as required by law.

Complaints: You may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.

Your choices about certain disclosures

When applicable, you may tell us your preferences about sharing information with family, friends, or others involved in your care and about disclosures for certain disaster relief purposes. We may share relevant information when you agree, when you have an opportunity to object and do not, or when otherwise permitted by law. You may opt out of fundraising communications if applicable.

Special legal restrictions

Other federal and Tennessee laws may provide stronger protection for mental health, HIV-related, genetic, minor, and other sensitive records. We will follow the more protective applicable law. PHI disclosed for certain healthcare functions is not automatically available for unrelated legal proceedings or advertising activities.

Changes to this Notice

We may change this Notice and make revised terms effective for PHI we maintain, as permitted by law. We will make the current notice available in our facilities and on our website, and provide a copy upon request.
